Under South African law a person can die either leaving a valid will, in which case the Law of Testate Succession will apply, or a person can die without leaving a valid will, in which case Law of Intestate Succession will apply.
In both instances the Act provides clear guidelines and rules which an Executor of an Estate has to follow in order to wind up an Estate successfully. An Executor is a person appointed by the Master of the High Court of South-Africa who is charged with the responsibility of ensuring that the Deceased Estate devolves in terms of the deceased's Will and according to the relevant Law. An Executor is generally nominated in terms of a Deceased's Will or in the event of Intestate Succession by nomination of the next of kin.
In the event of a person dying without a valid will, the law of intestate succession Act 81 of 1987 will apply, which might not necessarily give effect to the deceased's exact wishes.
